Generally speaking, your personal data will be retained as long as necessary for the fulfilment of the above purposes. In most cases, this will result in us keeping most of your personal data for a period of 10 years, which may however be extended in the event of litigation.

Transfer of your personal data

To achieve better quality or efficiency in the processing of your personal data, we may enter into contracts with third parties to carry out said processing on our behalf and only according to our instructions. Client data can for example be transferred to transport companies charged with ensuring delivery of the products. Service providers to whom your personal data are transferred, are bound by specific agreements and are required to keep your data securely.

In addition, as part of our compliance with statutory obligations, we may share your personal data with custom authorities.

Additionally, disputes and other incidents may lead us, in exceptional circumstances, to share personal data about you with police and other law enforcement bodies.

In the context of internal reporting within the Group of Sumitomo Bakelite Co., Ltd. (i.e. the group to which Vyncolit belongs), your personal data may also be shared with other group companies.

If and to the extent your employer would be subject to a potential sale, your personal data may also be shared with potential acquirers as part of routine pre-acquisition due diligence processes.

The technical processing and transmission of your personal data (whether within the Group of Sumitomo Bakelite Co., Ltd.or through third parties) may involve transmissions over various networks, including the transfer of your personal data to other countries.

It is informed that the company can count on the collaboration of third party service providers that may have access to your personal data and that will treat it on behalf of SBEB, as a consequence of their provision of the service. Normally, this could include data hosting service providers. SBEB follows a strict selection of service providers in order to comply with its data protection obligations and signs with them the corresponding data processing contract with, among others, the following obligations: apply appropriate technical and organizational measures, treat personal data for the agreed purposes and only according to the instructions, and delete or return the data once the provision of services ends.

Also, within our legal obligations, we must communicate your personal data to the Public Authorities that legally require it (for example, the Tax Agency, Tribunals and Customs Authorities).

In the event that, and to the extent that, your company is subject to a potential sale, your personal data may also be exchanged with potential acquirers in the context of routine due diligence processes prior to the acquisition.

Plazos de Conservación de sus datos personales

Por regla general, SBEB tratará sus datos personales en la medida en que sea necesario para el cumplimiento de los fines citados anteriormente. Es decir, trataremos los datos personales hasta que la relación contractual finalice y, tras ello, los conservaremos bloqueados a disposición de los Tribunales de Justicia o Administraciones Públicas competentes durante los plazos legales correspondientes, para atender posibles reclamaciones que se puedan formular o cumplir cuantas obligaciones legales nos sean aplicables.

Comunicación a terceros de sus datos personales

Se informa que la compañía puede contar con la colaboración de terceros proveedores de servicios que pueden tener acceso a sus datos personales y que tratarán los referidos datos en nombre y por cuenta de SBEB, como consecuencia de su prestación de tales servicios. Normalmente, esto podría incluir a proveedores de servicios de alojamiento de datos. SBEB sigue unos criterios estrictos de selección de proveedores de servicios con el fin de dar cumplimiento a sus obligaciones en materia de protección de datos y se compromete a suscribir con ellos el correspondiente contrato de encargado de tratamiento de datos mediante el que les impondrá, entre otras, las siguientes obligaciones: aplicar medidas técnicas y organizativas apropiadas, tratar los datos personales para las finalidades pactadas y atendiendo únicamente a sus instrucciones documentadas, y suprimir o devolverle los datos una vez finalice la prestación de los servicios.

Asimismo, en el marco de nuestro cumplimiento de las obligaciones legales, deberemos comunicar sus datos personales a las Autoridades y Organismos Públicos que legalmente nos lo requieran (por ejemplo, la Agencia Tributaria, Juzgados y Tribunales y Autoridades Aduaneras).

En caso de que, y en la medida en que, su empresa esté sujeta a una venta potencial, sus datos personales también podrán ser intercambiados con adquirentes potenciales en el marco de procesos rutinarios de due diligence previos a la adquisición.

Transferencias internacionales de datos personales fuera del Espacio Económico Europeo

El tratamiento de sus datos personales puede implicar la comunicación de los datos personales a países que no pertenezcan al Espacio Económico Europeo y que no ofrezcan un nivel adecuado de protección de datos personales.

Actualmente, estas transferencias de datos pueden tener lugar entre las diferentes compañías u oficinas del Grupo de Sumitomo Bakelite Co., Ltd., ubicadas en Japón, Hong Kong, Taiwán, Indonesia, Malasia, Singapur, Tailandia, Corea del Sur, India, Estados Unidos y Canadá.

Sus derechos

Tiene derecho a confirmar si en SBEB estamos tratando datos personales suyos y, en tal caso, (i) solicitar acceso a los mismos, (ii) solicitar su rectificación en caso de que detecte incorrecciones o considere que son inexactos, (iii) pedir la supresión de sus datos personales cuando dichos datos ya no sean necesarios, teniendo en cuenta para qué nos los proporcionó.

Si bien puede solicitar que sus datos personales sean eliminados en cualquier momento, es posible que nosotros tengamos que conservar ciertos datos personales a efectos del cumplimiento del contrato o para cumplir determinadas obligaciones legales. En cualquier caso, y como ya hemos indicado, estos datos los conservaremos bloqueados y no los utilizaremos para ningún otro fin.

Además, tiene derecho a oponerse al tratamiento de sus datos personales si existen circunstancias personales justificadas y a solicitar la limitación del tratamiento en circunstancias específicas. En estos casos dejaremos de utilizarlos, salvo por motivos legítimos imperiosos o el ejercicio o la defensa de posibles reclamaciones.

Por supuesto, tiene derecho a retirar en cualquier momento las autorizaciones específicas que nos haya podido dar para usar sus datos personales sin que ello pueda perjudicarle ni afectar a su condición de cliente, proveedor o subcontratista. Todas las acciones realizadas antes de la retirada de su consentimiento seguirán siendo lícitas.

Por último, cabe destacar que tiene derecho a recibir los datos personales que nos haya facilitado en un formato estructurado, utilizado habitualmente y legible mecánicamente (portabilidad de datos).
